Butler County OVI Blitz This Friday and Saturday

Drive Sober or Get Pulled OverThe Butler County OVI Task Force has announced that they will be conducting an “all-out” DUI blitz along Ohio 129 on Friday and Saturday night.

BUTLER COUNTY — 

An upcoming OVI blitz by the Butler County OVI Task Force is designed to deter impaired drivers.

Task force agents and the Ohio State Highway Patrol will saturate Ohio 129 in Butler County on Friday and Saturday. Additional officers will scour their jurisdictions for impaired drivers, according to a release.

“This is our continued effort to make sure the roads are safe and there are no unnecessary tragedies on our roads,” said Butler County Task Force Coordinator Carl Phillips. “Our mission is to save lives, and we will do our part to make our roadways safe.”

As you can see, this effort will involve not only Ohio State Highway Patrol forces,  but includes local jurisdictions who may well conduct additional saturation patrols.  If you are arrested on suspicion of misdemeanor OVI in Butler County, Ohio you may be confused about which Court will hear your case.  Butler County, Ohio is actually served by three “Area” municipal courts.

The Butler County Area I Court is presided over by the Honorable Robert H. Lyons.  Judge Lyons was appointed to the bench, and began presiding over affairs of the Butler County Area I Court in Oxford, Ohio, on February 8, 1999. He was re-elected in 2006 for his second term to serve until January 2013.  The territorial jurisdiction of the Area I Court includes the City of Oxford and all of Milford, Morgan, Oxford, Reily and Wayne Townships.  Area I Court is open Monday-Friday from 8 a.m. to 5 p.m.  Butler County Area I Court hears criminal and traffic cases on Thursday of each week. The Judge holds court from 10:00 A.M. to 12 noon. At 11:30 A.M, the Court hears Reviews of prior cases and cases with Orders to Appear. Prisoners are arraigned at approximately 1:30 P.M. Preliminary hearings, bench trials, and reviews of prior cases begin after the completion of the arraignments. Afternoon Court remains in session until all cases on the docket have been heard.

The Honorable Judge Kevin C. McDonough was appointed to the Area II Court bench on January 4, 2007. He was elected in November, 2008 to finish the unexpired judicial term for the Area II Court.  He sits in the historic courthouse in downtown Hamilton. The Area II jurisdiction covers Hanover, Fairfield and Liberty townships.  Area II Court is open Monday-Friday from 8 a.m. to 5 p.m.  Butler County Area II Court is in session on Wednesday of each week. The judge holds the morning session of court from 9:30 A.M. to completion. Traffic cases are heard beginning at 9:30 A.M. Humane association citations and park violations are heard beginning at 11:00 A.M.  The afternoon session of court begins at 1:30. Prisoners are arraigned at approximately 1:30 P.M. Preliminary hearings, bench trials, and reviews of prior cases are heard immediately after prisoners. The afternoon session of Court continues until all cases on the docket have been heard.

The Honorable Judge Dan Haughey was elected to the Butler County Area III bench on November 4, 2008.  The Area III jurisdiction includes the Butler County communities of West Chester and Monroe.  Area III Court is open Monday-Friday 8 a.m. to 5 p.m.  Butler County Area III Court is in session on Tuesday, Bench trials are scheduled on  Friday each month.  A Fine Review Docket is also scheduled on Friday each month.  On Tuesday, court is in morning session from 8:00 a.m. to completion and in afternoon session from 1:00 p.m. to completion.  The schedule is as follows: 8:00 a.m. Traffic, Operator’s License issues, Criminal and Domestic Violence dockets; 1:00 p.m. Felony Prisoner Arraignments, Probation Violations and Non-English speaking cases.  An interpreter is present for the afternoon docket. 1:30 p.m. Preliminary Hearings.

Super Bowl DUI Patrols 2013

SuperBowl_LogoThis weekend, more than 81 local law enforcement agencies around the state will be conducting more than 1,925 hours of enforcement activity and 1,100 hours of saturation patrols, funded by federal grants provided through OTSO.  The FBI compared saturation patrols vs. checkpoints in Ohio, Missouri and Tennessee.  The study showed that “Overall, measured in arrests per hour, a dedicated saturation patrol is the most effective method of apprehending offenders (Source: FBI Law Enforcement Bulletin, January 2003).  As this author has long argued, the saturation patrol is also more in keeping with American standards of justice than a checkpoint, as officers rely upon investigation and probable cause.  We believe that our system can deal with DUI without subverting the Constitution.

St. Patrick’s DUI Checkpoints Announced (Kettering, Beavercreek, Springfield, Dayton)

st pats LOGOThe Ohio State Highway Patrol has begun its “Drive Sober or Get Pulled Over” St. Patrick’s day enforcement initiative.  More than 78 local law enforcement agencies around the state will be conducting more than 2,100 hours of enforcement activity and 1,900 hours of saturation patrols in addition to 15 sobriety checkpoints, funded by federal grants provided through the Patrol’s Ohio Traffic Safety Office.  We will keep you posted as we continue to get updates.

CLARK COUNTY OVI CHECKPOINT – The Clark County OVI Task Force will be operating an OVI checkpoint within Clark County tonight to intercept impaired drivers as part of our ongoing enforcement efforts.  In addition, City, County and State Law Enforcement Officers will be working all weekend and through St. Patrick’s Day to keep our roads safe.

The checkpoint will begin tonight (3/15/13) at 8:00 p.m.  The location will be in Main St. in Enon, Ohio. 

MONTGOMERY COUNTY OVI CHECKPOINT – There will be an OVI checkpoint tonight starting around 8pm on Needmore Rd., near Wadsworth (off I-75 near the old Frisch’s restaurant).

A No-refusal checkpoint is planned for Saturday in Clay Township along St. Rt. 49 near Kimmel Rd.  A no-refusal weekend means that a judge is standing by to issue a warrant for a forced blood draw if a person refuses a breath test.

KETTERING EXTRA PATROLS – The city of Kettering will have extra patrols beginning at 5 p.m. on St. Patrick’s Day and will continue the extra patrols until 2 a.m.

GREENE COUNTY OVI CHECKPOINT - The Ohio State Highway Patrol has announced that they will conduct an OVI checkpoint in Greene County Saturday beginning around 11pm in front of the Greene on Indian Ripple Road.

The checkpoint will begin Saturday (3/16/13) around 9:00 p.m. The location will be on Indian Ripple Rd, Beavercreek, Ohio in front of the Greene Mall. 

COLUMBUS OVI CHECKPOINT – OVI Checkpoint Sat. night on OSU Campus at 17th and High St. Checkpoint will run from 9p-3am

Lucas County OVI Task Force will conduct a sobriety checkpoint in the Village of Holland. The checkpoint will be located on South McCord Road. Both northbound and southbound traffic will be checked. The checkpoint will run from 8 p.m. to 12 a.m. and manned by the Lucas County Sheriff’s Office, Holland Police, Whitehouse Police, Toledo Metro parks Rangers, University of Toledo Police, Swanton Police, and Oregon Police–all officers from Task Force agencies.

As always, Dayton’s St. Patrick’s Day celebration locations are trying to help you stay safe.  Three of Dayton’s most popular St. Patrick’s Day destinations, Flanagan’s Pub, The Dublin Pub and Boston’s Bistro will offer free non-alcoholic beverages to designated drivers.  The Crown Plaza will be offering a special “Dublin Pub” rate to party goers.  For this special rate call (937) 224-0800.  To make things even easier, Flanagan’s and the Dublin Pub are sponsoring a free shuttle to run you back and forth from the Crown Plaza.  Free parking is available to Flanagan Pub guests at the Montgomery County Fairgrounds and that have arranged it so that cars can stay there overnight if necessary.

You may notice more troopers on the roadways today – Thats because today is “All Out Day.”

All sworn officers from all ranks of the state Highway Patrol will take to Ohio roadways Friday in a safety and awareness campaign the agency is calling “All Out Day.” All available units will be out on the road to enforce traffic laws and look for any criminal activity.  The Ohio State Highway Patrol will be conducting “All Out Day” throughout Friday, April 19.  The initiative consists of high visibility enforcement on the roads to deter drunk driving.  We know of one OVI checkpoint which will be held in Warren County in conjunction with the law enforcement initiative.  Please follow Dayton DUI on Facebook to receive updates, or sign up for our free text alert service.  It is also a good idea to download the DaytonDUI Android App which gives you DaytonDUI at your fingertips.

The Trotwood Police Department will be conducting an OVI checkpoint tonight in the area of 1001 Shiloh Springs Road beginning at 6:30 p.m.

Warren County will be conducting an OVI checkpoint tonight between 10 p.m. to 2 a.m. at Ohio 741 and Courseview Drive in Mason.  Another checkpoint will be in Cincinnati.  Cincinnati’s will be 9 p.m. to 1 a.m. in the 400 block of Delta Avenue in Columbia Tusculum.

Multiple OVI Checkpoints Around Montgomery County This Weekend

It’s Cinco de Mayo!

In what can only be described as a “blitz,” the Ohio State Highway Patrol in conjunction with the Montgomery County OVI task force will be conducting multiple OVI checkpoints beginning Wednesday at 6:00 p.m.  All available units will be out looking for impaired drivers, texting drivers, distracted drivers and generally anyone committing an offense.  We have confirmed that there will be an OVI checkpoint in Vandalia.

The location of the OVI checkpoint announced earlier this will be held tonight on US 40 in Vandalia. The OVI checkpoint, funded by federal grant funds, is planned from 10 p.m. to 2 a.m.

OVI Checkpoint in Wilmington (Clinton County) & Cincinnati

sobriety checkpoint aheadThere will be an OVI checkpoint tonight in Wilmington at US-68 near SR-134, 7 p.m. to 9 p.m. There will be another  at US-22 near Progress Road, 10 p.m. to 12 a.m.  Troopers will also conduct aggressive saturation patrols in the area.

In Cincinnati an OVI checkpoint will operate in the 2700 block of River Road, from 9 p.m. to 1 a.m.

There will be an OVI checkpoint in Monroe at Cincinnati-Dayton Road near Todhunter Road from 8:30 p.m. until 1:30 a.m.

In his book Why People Obey The Law, legal scholar Tom Tyler argues that compliance with the law has less to do with deterrence (fear of penalty) than with the rational decision that complying with the law is in a person’s self-interest.  More important to their compliance is the decision that following the law is the right thing to do.  Having the biggest impact on their perception of the law is the belief in the legitimacy of the authority.  ”People who go to traffic court are less concerned with the outcome – even when it is a costly ticket or fine – than with the fairness of the process.” Vanderbilt, Tom. Traffic: why we drive the way we do (and what it says about us), 2008, pp 235.  Thus the societal norm that driving within the speed limit and driving without being impaired, is an agreed upon social construct and is enforced best by our agreement that violating these laws is dangerous and deserving of punishment.

We can conclude from the evidence above that when there is less respect for the law and/or the process is deemed to be unfair the most important factor in compliance is compromised.  Less effective governance means the law are less effective, which means that people are less likely to follow them.  How do we know this?  The answer lies in whether or not the enforcement of the law is perceived as corrupt.  According to indices compiled by the anti corruption watchdog Transparency International, the higher a country (or law) ranks on the corruption index the less interested in following the law.  ”Lode Vereeck, a Belgian economist at Hasselt University, has noted that in survey after survey of people’s attitudes toward traffic regulations, Belgians seem resistant; they’re more hostile than their neighbors to things like seat belt laws, lower speed limits, and drunk-driving laws” (thus more likely to drink before driving). Vanderbilt, Id.  Compared to the Netherlands (Belgiums nearest neighbor and best basis of comparison) the Belgians see their laws as more corrupt, leading to less adherence to the law and more traffic fatalities.  The nations that rank as the least corrupt – such countries as Finland, Norway, New Zealand, Sweden and Singapore – are the safest places in the world to drive.  The lesson we draw from the research is that wealth and enforcement affect traffic fatalities less than real or perceived corruption.

The premise of my argument herein is that OVI checkpoint and speed/red-light cameras are perceived as corrupt by the vast majority of citizens.  Our reliance on speed cameras and the attendant unfairness of the enforcement lessens the citizens adherence to the law.  The perceived unfairness of a sobriety checkpoint lessens and diminishes the drunk driving law.  The research suggests that following the law because it is fair and the right thing to do are more important than checkpoints and cameras.  Which raises the question to law enforcement and to the political elite.  If fairness is diminished at the cost of lives, are you doing a disservice by continuing the “corrupt” practices.  At some level you are making the decision between money for your department/city over the potential loss of life due to possible disrespect for the law.  I would argue (anecdotally) that respect for all law enforcement is diminished when they are perceived to be sanctioning unfair enforcement.  The courts are lowered in esteem when they are seen as unfair or “rigged” against the average citizen.

The reason that I put forth this argument is because I have spent my life dedicated to our system of justice.  I believe in our courts and in (the overwhelming majority of)  law enforcement officials.  I cannot go by silently and see the things I gave my life to broken.  I do not want our children to grow up in a world where the rule of law is scoffed at as a naive concept.  If my children (or yours) go into law enforcement I do not want their lives put in danger because they are seen as “other” rather than the agents of service and protection.  This issues goes to the very core of what we are and what we want our communities to be.  We can and should do better because “we are all in this together.”
